Terms and conditions
1.ELIGIBILITY
(i) No purchase is necessary to enter.
(ii) The competition is open solely to adults who are working at a company in the EMEA region aged 18 or over. Entries limited (save at Oracle's discretion) to one per person.
(iii) No employees of Oracle Corporation or its parent companies, subsidiaries, other affiliates, agents, advertising and promotion agencies, or such employees' immediate family members (parent, sibling or person residing in the same household) shall be eligible to win. Other restrictions as set out below may also apply.
2.HOW TO ENTER
(i) Participants will be eligible by sending an email to isvemea_de@oracle.com with the correct answers to the five questions detailed above, together with their name, address and phone number.
(ii)Participants must provide all requested information and, save at Oracle's discretion, will not be entered into the draw if they fail to do so. This information may be used by Oracle for marketing purposes, unless otherwise specified.
(iii) Oracle shall not be responsible for any phone, technical, network, electronic, computer, hardware or software failures of any kind, or for any misdirected, stolen, incomplete, garbled, or delayed Internet or e-mail computer transmissions, or for any lost, late, damaged, illegible, stolen, incomplete or misaddressed entries.
3.CLOSING DATE
The closing date for the prize draw shall be Friday 30 December 2005. All entries must be received by midnight on that day to be eligible for the draw.
4.SELECTION AND ANNOUNCEMENT OF WINNERS
(i) The potential winners will be selected by Oracle in a random drawing conducted on or about Friday 13 January 2005. Oracle's decision shall be final on all matters relating to the draw. Potential winners do not need to be present at the drawing to win.
(ii) Potential winners will be notified by mail, e-mail or phone. (No notification will be made to other participants, but for the names of the official winners participants should email a request to isvemea_de@oracle.com)
(iii) Potential winners may be required to sign an Affirmation of Eligibility & Liability Release, which if required must be returned to and received by Oracle no later than 15 business days after it is provided in order for potential winners to receive their prize. (Failure to do so if required will void the participant's eligibility and an alternate potential winner will be selected by a random drawing.)
5.PRIZES
(i) Oracle will award one prize. First prize will be one Pocket LOOX 720.
(ii)To receive their prize, winners may need to sign the Affirmation referred to above, and follow relevant delivery and other directions provided by Oracle. The winner shall be responsible for all applicable taxes and any other expenses not specified in these rules. If Oracle is unable to locate a winner for the purposes of delivery, an alternate potential winner will be selected by a random drawing.
(iii) Oracle has the option, at its sole discretion, of substituting a prize of equal or greater value if for any reason, including scheduling, a prize become unavailable. Prizes cannot be transferred, substituted, or redeemed for cash value except as provided herein.
6.GENERAL
(i) By entering the draw all participants consent to the disclosure of their names to other participants who ask to be informed of the names of the winners (pursuant to rule 4(ii) above).
(ii)Participants agree to release Oracle, its parent company, subsidiaries and affiliates from any and all liability for any injuries, losses or damages of any kind caused by or arising from this prize draw or award of any prize.
(iii) These rules shall be governed by the laws of England and the English courts shall have exclusive jurisdiction. The draw offer shall be void where prohibited or otherwise restricted by law. Odds of winning are dependent upon the total number of entries received.
