All Oracle Cloud services ordered prior to December 1, 2012, will be governed by the then-existing agreement referenced in your order. Effective December 1, 2012, all new ordering documents for Oracle Cloud services will reference the Oracle Cloud Services Agreement as the governing master agreement.
ORACLE CLOUD SERVICES AGREEMENT DOCUMENTATION
The following items are referenced in the Cloud Services Agreement and are available here for easy access.
The most recent published version of the Data Processing Agreement for Oracle Cloud Services (DPA) applies to all current Cloud Services orders and "add-on orders" that reference the DPA, whether placed before or after November 3, 2015. An "add-on order" is an order that updates the quantity or type of a previously ordered Cloud Service, such as by adding capacity, new user subscriptions, or additional SaaS service applications.
Oracle is making the new DPA apply to both new and existing Cloud Services orders in recognition of the need to replace the DPA's former reliance on the EU-US Safe Harbor Framework, which was invalidated on October 6, 2015 by the Court of Justice of the European Union (EU) in its Schrems judgment. As you will see, Section 7 of the DPA now states that covered transfers are subject to the EU Standard Contractual Clauses / Model Clauses or other appropriate transfer mechanisms that provide an adequate level of protection in compliance with the applicable requirements of Articles 25 and 26 of Directive 95/46/EC. Please refer to the DPA for additional details.
Your order for Oracle Cloud Services identifies the Oracle Cloud Services Agreement that governs the order. If your order is placed on or after March 19, 2016 and references the Oracle Cloud Services Agreement available at www.oracle.com/contracts, then the March 19, 2016 version of the Oracle Cloud Services Agreement applies to that order. For any "add-on order" to an original Cloud Services order, the version of the Cloud Services Agreement for Oracle Cloud Services in effect on the date of the original order will apply to the add-on order, even if the add-on order is placed after an updated version of the Cloud Services Agreement is published. An "add-on order" is an order that updates the quantity or type of previously ordered Cloud Services, such as by adding capacity, new user subscriptions, or additional SaaS service applications.
Your order for Oracle Data Cloud Services identifies the Oracle Online Data Agreement which governs the order. If your order is placed on or after August 29, 2016 and references the Oracle Online Data Agreement available at www.oracle.com/us/corporate/contracts/cloud-services/index.html, then the August 29, 2016 version of the Online Data Agreement applies to that order.
