<DIV class=pressRelease style="padding:15px 15px 15px 15px;"><h1>STATEMENT OF ORACLE CORPORATION</h1>

<div class="pressDate">Redwood Shores, Calif. – November 9, 2009 </div><p class="pressBody">Oracle&#39;s acquisition of Sun is essential for competition in the high end server market, for revitalizing Sparc and Solaris and for strengthening the Java development platform. The transaction does not threaten to reduce competition in the slightest, including in the database market. The Commission&#39;s Statement of Objections reveals a profound misunderstanding of both database competition and open source dynamics. It is well understood by those knowledgeable about open source software that because MySQL is open source, it cannot be controlled by anyone. That is the whole point of open source. </p><p class="pressBody">The database market is intensely competitive with at least eight strong players, including IBM, Microsoft, Sybase and three distinct open source vendors. Oracle and MySQL are very different database products. There is no basis in European law for objecting to a merger of two among eight firms selling differentiated products. Mergers like this occur regularly and have not been prohibited by United States or European regulators in decades.</p><p class="pressBody">The U.S. Department of Justice carefully reviewed the proposed acquisition during the normal Hart-Scott-Rodino review and considered it again when the European Commission initiated a second phase review. On both occasions the Justice Department came to the conclusion that there is nothing anticompetitive about the deal, including specifically Oracle’s acquisition of the MySQL database product. The U.S. Department of Justice approved the acquisition without conditions and terminated the waiting period under the Hart-Scott-Rodino Act on August 20, 2009. </p><p class="pressBody">Sun’s customers universally support this merger and do not benefit from the continued uncertainty and delay. Oracle plans to vigorously oppose the Commission’s Statement of Objections as the evidence against the Commission’s position is overwhelming. Given the lack of any credible theory or evidence of competitive harm, we are confident we will ultimately obtain unconditional clearance of the transaction.</p><h3>Cautionary Statement Regarding Forward-Looking Statements</h3><p class="pressBody">This press release contains certain forward-looking statements about Oracle and Sun, including statements that involve risks and uncertainties concerning the European Commission’s Statement of Objections, clearance of the transaction by the European Commission and satisfaction of other conditions to closing the transaction. When used in this press release, the words &quot;plans&quot; and “will” and other similar expressions and any other statements that are not historical facts are intended to identify those assertions as forward-looking statements. Any such statement may be influenced by a variety of factors, many of which are beyond the control of Oracle or Sun, that could cause actual outcomes and results to be materially different from those projected, described, expressed or implied in this document due to a number of risks and uncertainties. Potential risks and uncertainties include, among others, the possibility that the transaction will not close or that the closing may be further delayed and the possibility that Oracle or Sun may be adversely affected by other economic, business, and/or competitive factors. Accordingly, no assurances can be given that any of the events anticipated by the forward-looking statements will transpire or occur, or if any of them do so, what impact they will have on the results of operations or financial condition of Oracle or Sun.</p><p class="pressBody">In addition, please refer to the documents that Oracle and Sun, respectively, file with the Securities and Exchange Commission (the &quot;SEC&quot;) on Forms 10-K, 10-Q and 8-K for additional risks. You are cautioned not to place undue reliance on forward-looking statements, which speak only as of the date of this press release. Neither Oracle nor Sun is under any duty to update any of the information in this press release.</p><h3>About Oracle</h3><p class="pressBody">Oracle (NASDAQ: ORCL) is the world&#39;s largest business software company. In addition, they dominate in one or more technology or vertical market. Leaders deliver a suite that addresses all six core components [document management, document imaging, records management, workflow, Web content management, and document-centric collaboration], though these are not necessarily owned by them, tightly integrated, unique or best-of-breed in each area. <div class="pressDate">Redwood Shores and Foster City, Calif., Nov. 2, 2009</div><h3>News Facts</h3><div class="pressBullet"> Oracle and E2open announced today that <!-- TRANSIT - HYPERLINK --><!-- .http://www.e2open.com/solutions/multi-enterprise-integration/e2open-logistics-network/. --><a href="http://www.e2open.com/solutions/multi-enterprise-integration/e2open-logistics-network/" target="_top">E2open Logistics Network (ELN)</a> is now available as an integrated connectivity solution for <!-- TRANSIT - HYPERLINK --><!-- .http://www.oracle.com/us/products/applications/ebusiness/scm/018756.htm. --><a href="http://www.oracle.com/us/products/applications/ebusiness/scm/018756.htm" target="_top">Oracle® Transportation Management</a>, which simplifies the effort of establishing electronic integration between shippers, transportation carriers, and logistics service providers. </div><div class="pressBullet"> Electronic connectivity enables the advantages of timely and accurate information, lower transaction costs, and unlimited scalability. However, traditional approaches to implementing and maintaining integrations can be expensive and time consuming due to the myriad of technologies and formats, and the global nature of today’s transportation and logistics. </div><div class="pressBullet"> As a business process network specifically designed for global transportation and logistics processes, ELN offers several unique capabilities, including pre-built integrations with Oracle Transportation Management, a network of existing (reusable) connections to logistics-related trading partners, support for nearly all trading partner integration methods, and advanced self-service Integration-as-a-Service (IaaS) tools. </div><div class="pressBullet"> ELN offers a fast and cost-effective integration approach because it does not require any additional customer investment beyond Oracle Transportation Management and ELN and it allows trading partners to use their preexisting integration technologies. Alternatively, if a trading partner does not have a preexisting integration capability, ELN provides one at no extra cost. In addition, the reuse of ELN’s existing connections and standard maps, as well as its self-service IaaS tools, significantly reduce on-boarding work, enabling trading partners to be integrated in as little as one to three weeks. </div><div class="pressBullet"> ELN’s IaaS model provides a simple and predictable cost model with annual fixed-price fees ranging between $2,000 and $3,500 per connection—depending on the total number of connections—and a one-time fixed-price on-boarding fee of $1,000 per connection. Prices are not dependent on transaction volume. For many companies, ELN offers a significantly lower total cost of ownership compared to traditional integration approaches.</div><div class="pressBullet"> ELN is available now to Oracle Transportation Management customers. </div><div class="pressBullet"> E2open is a Partner in the Oracle PartnerNetwork.</div><h3>Supporting Quotes</h3><div class="pressBullet"> “Transportation processes are inherently network-centric, involving the exchange of information between many external parties, including carriers, suppliers, customers, and logistics service providers,” said Adrian Gonzalez, Director of Logistics Viewpoints at ARC Advisory Group. “Establishing and maintaining connectivity with a dynamic set of trading partners is an integral component of a transportation management system, but when evaluating solutions, many companies fail to consider the time, cost, and resources required to enable and manage a connectivity network. By delivering a transportation trading partner network via ELN, Oracle and E2open are enabling customers to eliminate a major obstacle to gaining the benefits quickly from a transportation management system.”</div><div class="pressBullet"> “Customers have been asking us for a simplified way to establish electronic connectivity between Oracle Transportation Management and their transportation trading partners,” said Derek Gittoes, Vice President, Logistics Product Strategy for Oracle. “By combining leading connectivity and transportation management capabilities, ELN gives Oracle Transportation Management customers a compelling alternative to help reduce their integration timeframes and costs.”</div><div class="pressBullet"> “We are excited to team with Oracle to dramatically simplify connectivity for Oracle Transportation Management customers compared to traditional approaches,” said Mark Woodward, CEO of E2open. “Our business process-centric approach, combined with our SaaS-based delivery of integration capabilities, reduces the time and cost necessary to achieve the benefits of automating logistics-related processes.”</div><div style="margin-top:25px;margin-bottom:-5px;"><div class="horidotted dottedspacer"> <!--spacer--></div></div><h3>Supporting Resources</h3>

NSHE has already realized improvements in the student experience by launching the new admissions module at the University of Nevada, Las Vegas and Truckee Meadows Community College – the first step toward providing seamless, user-friendly and cost-effective student services for all its institutions. As NSHE rolls out additional modules, it will offer students 24/7 access to academic information via easy-to-use, Web-based tools that will enable them to plan and track progress toward their education objectives and make online payments. By deploying the Oracle application suite statewide, NSHE expects to benefit from cost savings and efficiencies gained through data standardization and streamlined applications management. In addition, NSHE leverages <!-- TRANSIT - HYPERLINK --><!-- .http://www.oracle.com/database/index.html. --><a href="http://www.oracle.com/database/index.html" target="_top">Oracle Database</a> and <!-- TRANSIT - HYPERLINK --><!-- .http://www.oracle.com/enterprise_manager/index.html. --><a href="http://www.oracle.com/enterprise_manager/index.html" target="_top">Oracle Enterprise Manager</a> to more efficiently provision new technology, as well as provide a centralized view of critical applications and their underlying databases. With Oracle, Liberty has been able to scale with commodity hardware to minimize costs. The Oracle infrastructure also provides fault tolerance and redundancy, helping to ensure that the university’s global internet presence is not affected by an electrical outage or major disaster.
