ENTITLEMENT FOR SOFTWARE

THIS ENTITLEMENT, TOGETHER WITH A PAID INVOICE, EVIDENCES YOUR PURCHASE OF THE LICENSE RIGHTS UNDER THE TERMS OF THE ORACLE AMERICA, INC., SOFTWARE LICENSE AGREEMENT FOR THE ORACLE SOFTWARE INDICATED HEREIN UNLESS OTHERWISE AGREED IN WRITING BETWEEN YOU AND ORACLE AMERICA, INC.

Effective Date: Invoice date plus five (5) business days.

Licensee/Company: Per corresponding invoice(s).

Software: Sun GlassFish Enterprise Server/Oracle GlassFish Server

License Term: Perpetual (subject to termination under the SLA).

Licensed Unit: Four (4) Sockets, where a "Socket" means a physical location on a computer board onto which a single Processor has been mounted. A "Processor" means a chip that contains a collection of one or more cores.

Licensed unit Count: Per corresponding invoice(s).

Permitted Uses: You may use the Software for Commercial Use only, subject to and conditioned on Your compliance with the Additional Terms below.

Additional Terms:

1) Sun Directory Server Enterprise Edition Limited License (previously known as SJS Directory Server Enterprise Edition). Pursuant to this Entitlement you may use Sun Directory Server Enterprise Edition ("DSEE") for storage of (i) an unlimited number of Entries, solely to store usernames, passwords, and group ID's accessed by Software's user authentication and authorization features; or (ii) a limited number of Entries solely to store the configuration information required by Applications running on the Software, provided that in no event shall any Application have more than one thousand (1,000) such Entries. Storage of any information (including without limitation contact information and user preferences) except as otherwise explicitly provided in this section, or access to DSEE from other software products on a stand-alone basis requires purchase of an appropriate Entitlement for DSEE.

(a) For the purposes of this Additional Term No. 1, "Entries" shall mean a single distinguished name and its associated attributes.

(b) For the purposes of this Additional Term No. 1, "Application" shall mean executable code running in the context of the Software.

(2)GlassFish Message Queue Limited License. Pursuant to this Entitlement You may use GlassFish Message Queue (previously known as Java System Message Queue) for the sole purpose of exchanging Java Message Service messages between, from, or to applications deployed to one or more supported instances of the Software.

(3) No Diagnostic, Maintenance, Repair or Technical Support Services. The scope of Your license does not include any right, express or implied, (i) to access, copy, distribute, display or use the Software to provide diagnostic, maintenance, repair or technical support services for Oracle software or Oracle hardware on behalf of any third party for Your direct or indirect commercial gain or advantage, without Oracle's prior written authorization, or (ii) for any third party to access, copy, distribute, display or use the Software to provide diagnostic, maintenance, repair or technical support services for Oracle software or Oracle hardware on Your behalf for such party's direct or indirect commercial gain or advantage, without Oracle's prior written authorization. The limitations set forth in this paragraph apply to any and all error corrections, patches, updates, and upgrades to the Software You may receive, access, download or otherwise obtain from Oracle.

(4) Records and Documentation. During the term of the SLA and Entitlement, and for a period of three (3) years thereafter, You agree to keep proper records and documentation of Your compliance with the SLA and Entitlement. Upon Oracle's reasonable request, You will provide copies of such records and documentation to Oracle for the purpose of confirming Your compliance with the terms and conditions of the SLA and Entitlement. This section will survive any termination of the SLA and Entitlement. You may terminate this SLA and Entitlement at any time by destroying all copies of the Software in which case the obligations set forth in Section 7 of the SLA shall apply.
